Daniel Henry per ship Countess of Harcourt, assigned to Captain Dumaresq, charged with disobedience of orders. Captain Dumaresq states - On Sunday last I perceived a party of strangers leaving the hut of the prisoner and his wife. I went to the overseer to see if he knew who they were and to ascertain if he was aware of their being in the prisoners hut; he said that he did not know who they were nor had the prisoner mentioned to him that any one was coming to see him. I have two or three times told the prisoner and as often to his wife that no strangers are on any account to go into their hut without first apprising the overseer that there are people wishing to see them. I told them at the same time that I did not wish to debar them from seeing their friends only to notify when they came to see them. I have satisfied myself on various occasions that they have admitted people into their hut without notifying the fact of their being there the same day on Sunday. I saw a female named Hall and her companion go into the prisoners hut and remain there for some time without any word being sent up to the overseer. The prisoner admits that he was aware that he was not permitted to receive people into his hut without the permission of the overseer and the reason why the woman Hall was in his hut that she called there on her way to kitchen enquiring her way; that Smart and his wife was there one day his Master having given his wife permission to get someone to attend her during her confinement. The Bench find the prisoner guilty and sentenced him to receive twenty five lashes
